An expert witness and/or evaluator must meet the qualifications outlined by the FRE 702to ensure their testimony is reliable and valid. An expert witness testimony must also meet the Daubert Standard requirements. The Daubert Standard is used to determine if the testimony is based on scientific reasoning that is applicable to the facts of the case (LII, n.d). According to the Legal Information Institute (n.d), there are five factors when determining the validity of a methodology: the theory and/or technique can, or has been tested; peer reviewed and publication;known and/or potential error rate; existence of maintenance standards that control operation;acceptance within the scientific community.FRE 702 Qualifications As it relates to his formal education, Dr. George Turner has completed relevant,specialized casework that is applicable to this present case. While obtaining a master’s degree in psychology from Southern New Hampshire University, coursework was completed in graduate research methods, forensic psychology, measurement and assessment, assessment in forensic psychology, ethical practice, theories of personality and cognitive psychology.
