Dr. Smith is a new member of a large orthopedics practice in central New York. Shortly after arriving to this practice, he notices that one of the surgeons who hired him (Dr. Johnson) has alcohol on his breath in the late afternoons. Dr. Smith makes a point to see whether this is a pattern or just a coincidence.

After a period of about 3 weeks, Dr. Smith is convinced that Dr. Johnson (who is about 55) never has alcohol on his breath in the morning, when he spends time with patients in the office, or on coming back from surgery. However, Dr. Johnson does have alcohol on his breath virtually every afternoon by 4 pm or so. At this point, he is usually not seeing patients and is dealing with paperwork and making phone calls. Dr. Smith is concerned about this secret drinking, but he is not sure that it makes any difference because Dr. Johnson has never seemed impaired. He shows up when and where he is supposed to, and the alcohol on his breath is the only indication that he has been drinking.

The AMA site provides an overview of federal fraud enforcement and compliance planning and lists seven components of an effective program.

Any individual or entity providing health care services and submitting a claim for payment by the federal government must be alert to the potential for liability stemming from an inappropriately submitted claim. The federal government has the authority to investigate the claim’s propriety and the authority to impose sanctions where an investigation finds fault with a claim, ranging from a possibly inadvertent mistake to a determination that the claim was fraudulently submitted. This document provides the skeleton for how physicians and other health care professionals can acknowledge and proactively address the federal fraud enforcement environment through the establishment of a compliance plan.

The existence of an effective compliance plan provides evidence that any mistakes were inadvertent, and this evidence would be considered in determining whether a medical practice or other health care entity has made reasonable efforts to avoid and detect misbehavior. A compliance plan also will identify under-coding and improve communications within a practice setting. An effective compliance plan should include the following seven elements:

  1. A clear commitment to compliance. A compliance plan must ensure that everyone in the organization understands the obligation to comply with established and understood standards and that the organization will take actions to uphold those standards.
  2. Appointment of a trustworthy compliance officer with a high level of responsibility. The compliance officer will be considered to have the requisite authority if he or she is able to influence behavior and organizational practices.
  3. Effective training and education programs. There must be a routine training and education process that addresses the role of everyone involved in the organization and makes participation in the compliance program understandable.
  4. Auditing and monitoring. There must be a regular review of the organization’s claim development and submission process, starting from the point where a service for a patient is initiated through the submission of a claim for payment. The monitoring process includes a methodology to facilitate employee reporting of suspected situations of fraud or abuse.
  5. Communications. Organizations must maintain an effective communications process, including a “hotline” procedure to facilitate reporting of suspected violations.
  6. Internal investigation and enforcement. Organizations must be able to conduct an appropriate investigation and take disciplinary actions.
  7. Response to identified offenses and application of corrective action initiatives. On the identification of a compliance problem, organizations have a responsibility to take demonstrable corrective actions, including steps to prevent further similar offenses.

Students will create an original, comprehensive report for the senior management of a healthcare organization that addresses an issue of legal and/or ethical concern that has occurred, or could occur, that requires the application of concepts and knowledge derived from this course and its associated work. Students are encouraged to create a project that can be of practical value in their professional lives. However, projects must be original, unique, and created for this course. In Week 3, students posted a general topic/issue idea, including the substantive context, how the topic is of interest/importance to the organization and student, and the general area(s) of law applicable. One of the goals is to maximize the value of the projects for the entire class, so each project must be original and unique in scope and content.

In Week 7, students will submit the project to the instructor in Canvas.

Project Guidelines

While students are encouraged to be creative, each project MUST:

  • Clearly state the specific issue or topic under consideration, including background, facts, involved parties
  • Explain how/why the topic/issue is relevant/important to the senior management and to the organization
  • Explain the potential consequences for any action or inaction on the part of the organization in dealing with the issue
  • Propose a recommended course of action, based upon your research and the concepts discussed in this course
